Today. Were gonna finally learn some of the insider information about tickets and how how point system works and just so you will know not to get any tickets. If you do get them you know how they will work against you so veronica.
Im glad that youre here real happy to have you here. Thank you for having me can you explain to the audience in regards to the point system. And how it works because i mean theres some misnomers out there about what tickets can get certain points.
And just kind of clear all that up sure well anytime. You have a traffic citation and you either pay. The citation or you go to trial.
And you lose and you accumulate. A guilty conviction. Then youre going to have points.
Assists. And each one of those traffic citations carry between two and six points. Know the citations that will carry the most points are going to be your aggressive driving charges or passing a stopped school bus illegally those will carry six points your reckless driving will carry four points and most of your speeding tickets are going to carry between three and six points.
So whats important to remember is that if you get more than 15 points. In a 24 month period. Then your license will be suspended and if youre under 21.
And you have any citation that carries four points or more you will be suspended for a year. So thats important to remember now you mentioned about your license being suspended. I dont know how it is in in the georgia laws.
But i know in my home state in california. They have what they call a restricted license. Where youre only allowed to drive to and from work or to and from school.
Do they have such a thing in georgia. Yeah. So you have whats called a limited permit and this is for those who dont have a full drivers license a lot of times that will be for your young.
Drivers your teen drivers who have a limited permit so youre limited permit and a large permit is a little bit different most of the time. If you lets say for instance you get a dui if its your first conviction. Youll get whats called an affidavit a first conviction and youll be able to get a limits that permit which would allow you to go to school medical and yeah.
And and possibly even go to religious services. So that sort of limited permit as opposed to your learners permit for new drivers. Okay something else that comes up a lot of times especially you mentioned earlier about the dui.
I know sometimes theyre required to get an sr 22. Can you explain a little bit. How that works.
I mean i get requests every once in a while thats not our market or niche market. But every once in a while you know somebody that might be a professional they made a mistake they might have to have that right so you so you get your sr22 maybe. When youve had a suspension on before before or not able to get insurance.
So youll need that sr22 to be able to later get insurance. Okay a lot of times. Ive had situations where people will call my office and theyll ask me or some of the other agents here hey you know i got i know i got this ticket that just happened a couple weeks ago.
My renewals coming up in maybe four months and they were asking me well. What do i do and ive mentioned to them that they should probably seek advice from an attorney and such as yourself. What is the best way to try to at least calculate whether its for them to do you know to go ahead and go that round what would you recommend well i always recommend people that receive any type of citation to at least consult with an attorney getting a traffic a conviction for a traffic offense has more implications than a lot of people think about or no traffic citations in georgia are misdemeanor offenses.
And also when youre thinking about well my tickets only you know my citation is only 150. But you dont think about the other ramifications that may go along with having that traffic citation for instance your the points that accumulate on your license from that citation are going to stay on your license for two years and insurance companies are going to look at those citations that are on your motor vehicle records so it may only cost you 100 for the site to pay the citations but citation. But the ramifications may be much larger financially down the road.
If youre paying for that citation and increase premium for two years. It probably gonna cost you a lot more than what it costed to at least consult with an attorney and possibly even have them handle it in court for you okay. I know sometimes people call that dad there were no points.
They were told hey if i paid the ticket upfront then the points go away. But then theyre surprised when we run the motor vehicle report in and say hey theres a speeding ticket right yeah so here in georgia. If you get a citation that is 15 miles or more over the speed limit.
And you just go ahead and pay it its going to show up on your record. If its 14 or below 14. The miles over the speed limit or below.
It will not show on your record. So just remember that in terms of speeding also important force for speeding if you are on a highway. And youre going 85 or more.
Then thats considered a super speeder. Not only are you going to have to pay the for the citation. But youre going to after you pay that fine or go to court and have a trial in that case youre going to get a letter in the mail from the state.
Saying. You have to 30 days to pay an additional 200 fine. So thats important to remember as well.
But any im in georgia. Any speeding citation that is 15 miles or over the speed limit. 15 miles over or more than the speed limit youre going to get points.
If you just decide to go ahead and pay that citation okay the last question that i have for you was i know in talking to you in private. We had you had mentioned in regards to being able to i guess pull back a guilty plea on a pass ticket can you explain that option that people may not even know that they have sure so there are a couple of ways to keep points off your license or if youve already gotten those points to get those points off your license and the first way is whats called a nolo contendere plea. So once every five years you can plead nolo contendere to a charge this attention itself will still show up on your record.
But you wont have any points for that particular citation and thats for most of your citations itself for a dui and other special circumstances and so thats once every five years. The second way is with the assistance of an attorney you can get whats called too fast for conditions. And thats not something that sent in to the department of driver services either so thats another way to keep the citation off your record.
But the third way which youre just speaking about its called a motion to withdraw your guilty plea. So in georgia. If you decide to just pay a citation or if you just go to court and you enter a guilty plea.
So that you can get out of court and get back to work you if you hire an attorney to file a motion to withdraw your guilty plea. Within the term of court then the its discretionary for the judge to allow you to withdraw that plea. So you can go back to the drawing or to kind of see if you can just to see if you can get a bit of better deal.
And theres one more and that is actually going through the department of driver services and having a defensive driving class taking a defensive driving class in person. Its a six hour course. Once every five years you can remove up to seven points from your license in order to to to have a better driving record and a lot of times.
Ill tell people this is a little free legal advice. If youll take that defensive driving course before you actually go to court. Then you may be able to to work a better deal or get your speeding citation reduced such that it may not even show up on your record to begin with okay well great i appreciate you coming.
